యశ్వంత్ విష్ణు చంద్రచూడ్ (మరాఠీ: यशवंत विष्णू चंद्रचूड) (12 జూలై 1920 – 14 జూలై 2008) 16వ భారతదేశ ప్రధాన న్యాయమూర్తిగా 1978 ఫిబ్రవరి 22 నుండి 1985 జూలై 11 వరకు పనిచేశాడు. భారత దేశ చరిత్రలో అత్యధిక కాలం 7 సంవత్సరాల, 4 నెలలు భారత ప్రధాన న్యాయమూర్తిగా పనిచేసిన వ్యక్తిగా ఇతడు ప్రసిద్ధుడు.

భారత ప్రధాన న్యాయమూర్తిగా[మార్చు]

ఇతడు మొరార్జీ దేశాయ్ ప్రధానమంత్రిగా ఉన్నప్పుడు జనతా ప్రభుత్వ హయాంలో ప్రధాన న్యాయమూర్తిగా నియమించబడ్డాడు. ఇతడు పదవిలో ఉన్న కాలంలో "కిస్సా కుర్సీకా" కేసులో సంజయ్ గాంధీని జైలుకు పంపాడు. కొంతకాలానికి ఇందిరాగాంధీ నేతృత్వంలోని కాంగ్రెస్ ప్రభుత్వం తిరిగి అధికారం చేపట్టాక ఇతడు కేంద్ర ప్రభుత్వానికి బలమైన ప్రత్యర్థిగా మారాడు. న్యాయవ్యవస్థలో ప్రభుత్వం జోక్యం కల్పించుకోకుండా స్వతంత్రంగా వ్యవహరించడానికి ఇతడు తోడ్పడ్డాడు. ఈ కారణం చేతనే ఇతని పదవీ విరమణ తరువాత ఎటువంటి ప్రభుత్వ పదవీ ఇతనికి వరించలేదు.

హెబియస్ కార్పస్‌ కేసు[మార్చు]

భారత రాజ్యాంగ చరిత్రలో ఈ కేసు అత్యంత ప్రాముఖ్యతను సంతరించుకుంది. ఇందిరా గాంధీ ప్రధానిగా ఉన్నప్పుడు విధించిన భారత అత్యవసర స్థితి (1975-1977) సమయంలో ఐదు మంది సుప్రీం కోర్టు సీనియర్ జడ్జిలతో కూడిన ధర్మాసనం ఈ హెబియస్ కార్పస్ కేసు విచారణను చేపట్టింది.(A.D.M. Jabalpur vs. Shukla). మీసా చట్టం క్రింద నిర్భందించబడిన వారు ఈ కేసులో తమకు భారత రాజ్యాంగంలోని ఆర్టికల్ 21 క్రింద సంప్రాప్తమైన జీవించే హక్కు, స్వేచ్ఛాహక్కును ఎమర్జెన్సీ కాలంలో తొలగించరాదని వాదించారు. The Indian constitution during that time itself provided that all fundamental rights, including the right to life under article 21 of the constitution, could be suspended during an Emergency. The Habeas Corpus majority decision therefore deferred to the original intent of the framers of India's constitution. However, the Indira Gandhi government flagrantly misused their powers during the Emergency, and as a result, the doctrine of "original intent" has never taken a firm hold in India.

Despite widespread high court support for Habeas Corpus, Justice Chandrachud went along with Justices A.N. Ray, P.N. Bhagwati, and M.H. Beg, to reject this position,[1] stating: in view of the Presidential Order dated 27 June 1975 no person has any locus to move any writ petition under Article 226 before a High Court for habeas corpus or any other writ or order or direction to challenge the legality of an order of detention. The only dissenting opinion was from Justice H. R. Khanna, who has been widely acclaimed for his dissent. Khanna's dissenting opinion was "activist" - and because of the legitimacy his opinion attained, "judicial activism" in India is considered more legitimate than elsewhere.

Both Justices Chandrachud and Bhagwati did much to subsequently atone for their majority opinions in the habeas corpus case.

మినర్వా మిల్స్ కేసు[మార్చు]

In the Minerva Mills case, the Supreme Court provided key clarifications on the interpretation of the basic structure doctrine. The court unanimously ruled that the power of the Parliament of India to amend the constitution is limited by the constitution. Hence the parliament cannot exercise this limited power to grant itself an unlimited power. In addition, a majority of the court also held that the parliament's power to amend is not a power to destroy. Hence the parliament cannot emasculate the fundamental rights of individuals, including the right to liberty and equality.

షా బానో కేసు[మార్చు]

In the Shah Bano case, the bench headed by Chief Justice Chandrachud took a secular stand. It invoked a provision in The Criminal Procedure Code, 1973 which is a secular legislation to order maintenance compensation to the divorced Muslim woman.

This case caused the Rajiv Gandhi government, with its absolute majority, to pass the Muslim Women (Protection of Rights on Divorce) Act, 1986 which diluted the secular judgment of the Supreme Court.

వ్యక్తిగత జీవితం[మార్చు]

Chandrachud was educated at Nutan Marathi Vidyalaya high school, Elphinstone College and the ILS Law College in Pune.[2] Justice Y.V. Chandrachud died on 14 July 2008 shortly after he was admitted to the Bombay Hospital. He is survived by his wife Prabha, his son Dhananjaya Y. Chandrachud, current judge of Supreme Court of India and in line to become Chief Justice of India himself in 2022 [3] and his daughter Nirmala.
